In no event shall ELIKSR Formulations, its officers, directors, employees, or affiliates be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including, but not limited to, personal injury, pain and suffering, illness, death, lost profits, or lost data, resulting from (a) the use or inability to use the products; (b) the misuse of the products; (c) any adverse reaction or allergic response to the ingredients; or (d) any other claim related in any way to your purchase of the products.

Notwithstanding the foregoing, our maximum aggregate liability to you for any claim arising out of or relating to these Terms or the products sold shall be limited to the purchase price of the specific product in question.

 

6. Indemnification

 

You agree to indemnify, defend, and hold harmless ELIKSR Formulations, its officers, directors, employees, agents, and suppliers from and against any and all claims, demands, liabilities, damages, and costs, including reasonable attorneys’ fees, arising from or related to: (a) your breach of these Terms & Conditions; (b) your misuse of the product; or (c) your violation of any law or the rights of a third-party.

 

7. Dispute Resolution & Governing Law

 

A. GOVERNING LAW These Terms & Conditions and any separate agreements whereby we provide you products shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.

B. MANDATORY ARBITRATION Any controversy or claim arising out of or relating to these Terms, the products, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Arbitration shall take place in Cache County, Utah, or as mutually agreed upon.

C. WAIVER OF CLASS ACTION You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, no arbitration or claim shall be joined with any other; you have no right or authority for any dispute to be arbitrated on a class-action basis or to utilize class action procedures. You hereby waive the right to a trial by jury.

 

8. Billing & Payments

 

We accept all major payment methods through Shopify Payments. By providing payment information, you represent and warrant that the information is accurate and that you are authorized to use the designated payment method.

 

9. Pre-Order Terms

 

A. FULFILLMENT WINDOW Pre-order fulfillment information will be defined here as new pre-orders become available.

B. REFUND ELIGIBILITY

  • Pre-orders are fully refundable until the moment they are shipped.

  • Pre-orders become non-refundable after shipment unless the item is lost, damaged, or defective upon arrival.

  • Orders may be canceled within 24 hours of placing the pre-order for a full refund.

C. DELAYS If significant delays occur beyond the stated shipping window, customers will be notified via email.
